In circumstances where the general Terms & Conditions apply or refer to the Sales Terms, all SPI wheel orders are subject to the following additional terms and conditions:
1.1 Orders
All orders are subject to acceptance by STW. STW reserves the right to decline or cancel any order in whole or in part for any reason, including but not limited to unavailability of stock or pricing errors.
1.2 Pricing and Payment
Prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Full payment is required prior to dispatch unless a credit arrangement has been approved with payment expected within thirty (30) days of the end of the month of the invoice.
1.3 Delivery
STW will not be liable for delays caused by third parties, events beyond its control, or the Customer’s failure to provide necessary information.
1.4 Risk and Title
Risk in the Goods passes to the Customer upon delivery. Title to the Goods remains with STW until full payment is received.
2. Warranties and Consumer Guarantees
2.1 Statutory Guarantees
Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage subject to the limitations in section 2.3. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
2.2 Manufacturer’s Warranty
In addition to your rights under the ACL, STW offers a standard warranty on Goods for a period of twelve (12) months from the date of invoice, covering defects in materials and workmanship under normal use. This warranty excludes:
- Damage due to misuse, abuse, or neglect;
- Overloading or misapplication of the wheel and tyres;
- Modifications or repairs not authorised by STW;
- Specific design for an application where there is a high risk of extreme conditions for the use of the wheel(s) or components;
- Normal wear and tear.
To make a warranty claim, the Customer must notify STW in writing and provide proof of purchase. This requires the completion of the Goods Return Authorisation Form, and STW will inspect the Goods before repair or replacement is arranged.
2.3 Limitations
To the maximum extent permitted by law, STW excludes liability for indirect or consequential loss or damage arising out of or in connection with the sale or use of the Goods.
2.4 Refunds
Subject to the General Terms and Conditions of Sale, customised specialised wheels under warranty will only be refunded in the form of a credit to the value of the warranty claim to a Customer’s account or provided as a credit note. Credits are non-transferable and expire after three (3) years if unused.
